You ("User" or "You") are welcome to access the NineData SaaS Platform, https://www.ninedata.cloud, by NineData Technologies ("NineData" or "we" or "the company"), so as to use the products and services provided by NineData.

1. Acknowledgment

Before you use the services of this Platform for the first time, you shall carefully read and choose whether to accept this Terms of Service (this "Agreement").

Once you click to confirm or elect to use the services of this Platform or otherwise elect to accept this Agreement, it means that you have fully read, understood and accepted all the provisions in this Agreement and have agreed with this Platform to become a User of this Platform. By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. NineData does not permit those under 18 to use the Service.

You understand that currently NineData is in Beta period and may provide free trial for testing purpose with "AS IS" clause.

2. Service Contents

This Service means the products and services provided by www.ninedata.cloud, and the technical support service you apply for, and NineData agrees to provide to you.

3. Free trial period and Beta

You understand and agree that NineData is currently in beta period, and provides you with free services.

NineData will announce the billing policy and specification 10 business days in advance by publishing an announcement on the website or sending a notice on the website.

Once new billing policy announced, if you still use the related services of NineData, you should pay according to the charging policy in effect at that time. If you refuse to pay the service fee after the annnoucement, NineData will have the right to stop the services to you, and has the right not to continue to retain your resources and data.

4. Rights and Obligations of Users

After successfully activating NineData service, you have the right to require NineData to provide you with services in accordance with these terms and the service descriptions, technical specifications, etc.

When You create an account with Us, You must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

The laws of the country, excluding its conflicts of law rules, shall govern this terms and your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

You must also ensure that you are not the subject of trade restrictions, sanctions or other laws and rules imposed by any country, international organization or territory. Otherwise, you may not be able to properly register and use the Services.

5. Disputes Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the company.

6. Rights and Obligations of NineData

NinaData shall have the right to suspend, discontinue or terminate Your service during Beta and free trial period.

7. Scope of Liability and Limitation of Liability

During the BETA period and free trial, THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

8. Change of Terms

NineData reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision occur, NineData will make reasonable efforts to provide at least 10 days’ notice prior to any new terms taking effect.

By continuing to access or use NineData's Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
